Divorce Parenting Mediation Financial Assistance

Grant 

You may qualify for the Grant if:

  1. You have a minor child in common with the other party, AND
  2. You or your children receive public assistance, AND
  3. You do not have a lawyer, or you have a pro bono lawyer (you do not have to pay for your lawyer)

If you think you may qualify for the Grant, please fill out the Mediation Payment Worksheet and file it with the court.

If the Court determines that you qualify for the Grant, then you do NOT have to pay for the first four hours of mediation, the mediation fee will be paid for through a grant the Office of Mediation and Arbitration receives from the New Hampshire Department of Health and Human services. 

If you go beyond the four hours, the mediator must seek approval from the Office of Mediation and Arbitration. If approved, the fee for those additional hours will be determined based upon the sliding scale described in Rule 48-B. The fee for the additional hours will be paid by the Fund upfront, but you will need to repay the fee for the additional hours to the Office of Cost Containment.

Fund (with kids) 

You may qualify for the Fund (with kids) if:

  1. You have a minor child in common with the other party, AND
  2. Your income is less than 200% of the Federal Poverty Line  

If the Court determines that you qualify for the Fund (with kids), then the Family Mediation Fund will pay the mediation fee upfront, and you will repay the fee to the Office of Cost Containment after mediation occurs. Please refer to Supreme Court Rule 48-B(5)(i) and RSA 461-A:18 for more information. If you qualify for the Grant and the Fund, the Grant will pay the fee. 

If you think you may qualify for the Fund (with kids), please fill out the Mediation Payment Worksheet and file it with the court.

Fund (without kids)

You may qualify for the Fund (without kids) if:

  1. You do not have any children in common with the other party, AND
  2. Your income is less than 200% of the Federal Poverty Line

If the Court determines that you qualify for the Fund (without kids), then you do NOT have to pay for the first four hours of mediation, the mediation fee will be paid for by the Family Mediation Fund. Please refer to Supreme Court Rule 48-B(5)(ii) for more information.
